1. Preamble
1.1. The website WhileResume.com (hereinafter "the Site"), accessible at the URL https://whileresume.com/, allows in particular:
- candidates to create and host their CV, apply for offers, share their profile;
- recruiters (companies or professionals) to publish job offers, consult CVs, manage applications.
1.2. These Terms of Use (ToU) are intended to define the rights and obligations of each user of the Site, as well as the conditions of access to the services.
1.3. By accessing the Site or using its services, any user declares to accept these ToU without reservation.
2. Definitions
Here are some key definitions to clarify the roles on the Site:
- User: any person accessing the Site, whether registered or not.
- Candidate: a User who creates a personal account, completes their CV, applies for offers.
- Recruiter: a legal person (company) or natural person (professional) who publishes job offers or consults CVs.
- Account: the personalized space that a User (Candidate or Recruiter) obtains after registration.
- Services: the features offered by the Site (CV creation, job posting, consultation, etc.).
3. Access and Registration Conditions
3.1. To access certain services of the Site, the user must register and create an account by providing true and accurate information.
3.2. Each user is responsible for the confidentiality of their username and password. They undertake to immediately inform the Site editor in case of unauthorized use of their account.
3.3. The editor reserves the right to refuse registration, suspend or delete an account in case of non-compliance with the ToU.
4. Use of Services
4.1. For candidates:
- They can create, modify and delete their CV.
- They can apply for offers published on the Site.
- They can set visibility parameters (for example, make their CV public, visible only to recruiters, anonymized, etc.).
4.2. For recruiters:
- They can publish job offers.
- They can consult CVs (within the limits of the rights granted by candidates).
- They undertake to use CVs and candidate data only for permitted purposes (recruitment, legitimate contact) and in compliance with applicable law.
4.3. The editor may offer free and/or paid services. The specific conditions of paid services will be defined in annexes or specific contracts.
5. Content and Intellectual Property
5.1. Each user retains ownership of their content (CV, texts, images, etc.).
5.2. By publishing content on the Site, the user grants the editor a non-exclusive, worldwide, royalty-free license to host, reproduce and distribute this content according to the purposes of the Site (for example, so that recruiters can access it).
5.3. The editor remains the owner of the Site elements (design, code, database, etc.) and all related intellectual property rights. Any unauthorized reproduction is prohibited.
6. Personal Data
6.1. The Site collects and processes personal data (CV information, contact details, etc.).
6.2. Data processing is carried out in accordance with the General Data Protection Regulation (GDPR) if applicable. (See also Privacy Policy, Privacy Notice.)
6.3. Users have the following rights: access, rectification, deletion, objection, limitation, portability.
6.4. The editor undertakes to secure personal data through appropriate technical means.
7. Liability
7.1. The Site editor strives to ensure the availability, reliability and security of the Site, but cannot guarantee permanent availability without interruption or error.
7.2. The editor cannot be held responsible for direct or indirect damages resulting from the use (or inability to use) the Site, except in case of serious or intentional fault.
7.3. Users are responsible for the accuracy of the information they provide (for example their CV, their offers, etc.).
8. User Behavior / Best Practices
8.1. Each user undertakes to comply with applicable laws, not to publish illegal, defamatory, discriminatory content, or content infringing the rights of others.
8.2. As a recruiter, the user undertakes to contact candidates only for legitimate recruitment purposes, and not to misuse data (for example by reselling it, using it out of context without consent).
8.3. In case of misuse, the editor may suspend or delete the account.
9. Duration, Modification of ToU
9.1. These ToU are applicable from acceptance by the user.
9.2. The editor reserves the right to modify the ToU at any time. Users will be informed of modifications (for example via email or on the Site) and the new ToU will apply from their effective date.
9.3. If the user does not accept the modified ToU, they may stop using the service and close their account.
10. Termination / Account Deletion
10.1. Each user may request the deletion of their account at any time via their personal space or by contacting the editor.
10.2. The editor may also delete an account in case of non-compliance with the ToU, prolonged inactivity or for other legitimate reasons.
10.3. Upon account deletion, user data may be deleted or anonymized, except for legal retention obligations.
11. Payment (if applicable)
11.1. If the Site offers paid services, the pricing conditions, payment methods, billing, etc., will be specified in General Terms of Sale or Specific Conditions.
11.2. Non-payment may result in suspension of access to paid services.
12. Third-Party Intellectual Property

12.2. They release the editor from any liability in case of third-party claims for violation of copyright, trademarks, or other intellectual property rights.
13. Hyperlinks
13.1. The Site may contain links to third-party sites. The editor is not responsible for the content of these sites.
13.2. The editor may also authorize links to its Site: any link setup must be done without denigrating the brand or the Site.
14. Applicable Law & Disputes
14.1. These ToU are governed by French law.
14.2. In case of dispute, the parties will endeavor to find an amicable solution. Otherwise, the competent courts will be those of Paris.
15. Miscellaneous Provisions
15.1. If a provision of the ToU is deemed invalid or unenforceable, it will not affect the other provisions.
15.2. The fact that the editor does not exercise a right or apply a sanction does not constitute a waiver of that right.
