General Terms and Conditions of Sale

1. Purpose

These General Terms and Conditions of Sale (hereinafter the "GTC") aim to define the terms and conditions under which the Whileresume platform (hereinafter the "Platform"), operated by MIRTILLO EURL, 2 rue de la hollau, 67540, OSTWALD, France, offers companies and recruiters (hereinafter the "Client") a job listing publication service (hereinafter the "Service").

Any order implies full and unconditional acceptance of these GTC.

2. Description of the Service

The Service consists of:

  • The publication of job listings on the Whileresume Platform, visible to registered candidates and visitors;
  • Connecting the Client with interested candidates via applications received directly on the Platform;
  • Access to a recruiter dashboard for managing published listings and received applications.

The Platform reserves the right to improve, modify, or evolve its services at any time, without entitling the Client to any compensation.

3. Subscription and Publication Terms

  • Access to the Service is offered in the form of an annual subscription allowing the publication of job listings on the Platform, according to available plans;
  • The subscription is entered into for a period of one (1) year from the date of subscription, automatically renewed for successive periods of one (1) year, unless terminated by the Client in accordance with Article 7 below;
  • The Service is reserved for professionals (companies, recruitment agencies, etc.) wishing to publish lawful and genuine job listings;
  • The Client guarantees that the published listings correspond to genuinely available positions and contain no discriminatory, misleading, or unlawful content, particularly in accordance with applicable employment law.

4. Pricing and Billing

The annual subscription price is indicated on the Platform in euros (EUR) or US dollars (USD), according to the Client's choice at the time of subscription. Prices are shown excluding taxes (ET) and the applicable tax is specified at the time of order based on the Client's country.

Whileresume reserves the right to modify its pricing at any time, provided at least thirty (30) days' prior notice before the annual renewal date.

Invoices are issued annually, on the subscription or renewal date, and are payable upon receipt by credit card or bank transfer, unless otherwise agreed in writing.

In the event of automatic renewal, the Client will be notified of the upcoming renewal by email at least thirty (30) days before the renewal date.

Any late payment will automatically result, without prior formal notice, in late payment penalties calculated at the applicable legal rate, as well as a flat-rate recovery fee of €40 (Article L441-10 of the French Commercial Code).

5. Client Obligations

The Client agrees to:

  • Publish only genuine, accurate job listings compliant with applicable regulations, particularly regarding non-discrimination in hiring;
  • Not use the Platform to distribute misleading, fraudulent listings or listings unrelated to actual recruitment;
  • Handle received applications in compliance with applicable personal data protection legislation (GDPR) and not use candidate data for any purpose other than recruitment;
  • Not reproduce, resell, or exploit candidate data or Platform features for third-party commercial purposes.

In the event of non-compliance, Whileresume may suspend or terminate the Client's access without compensation or refund, and reserves the right to immediately remove any non-compliant listing.

6. Listing Moderation

Whileresume reserves the right to moderate, reject, or remove any listing that does not comply with its editorial guidelines or applicable regulations, without obligation to provide justification and without entitling the Client to a refund in the event of a clear breach of their obligations.

The Platform is not responsible for the content of listings published by the Client, who assumes full editorial and legal responsibility thereof.

7. Termination

The Client may cancel their subscription at any time via their online account or by email addressed to support, no later than thirty (30) days before the annual renewal date. Termination takes effect at the end of the current annual period, with no pro-rata refund for the remaining period.

Whileresume reserves the right to immediately suspend or terminate the Client's access in the event of a serious breach of these GTC, without any refund being due.

8. Intellectual Property

All content, trademarks, logos, and elements of the Platform remain the exclusive property of Whileresume. The Client acquires no intellectual property rights over the Platform or its content. By publishing a listing, the Client grants Whileresume a non-exclusive license to distribute said listing on the Platform and its potential distribution partners.

9. Personal Data

The Client is informed that use of the Service involves the processing of personal data (see Privacy Policy – Recruiters/Companies). As the data controller for the applications they receive, the Client agrees to comply with the GDPR when processing candidate data.

10. Applicable Law and Jurisdiction

These GTC are governed by French law.

Any dispute relating to their execution or interpretation shall be submitted to the exclusive jurisdiction of the courts of Ostwald.
